The subclass 309/100 Australian partner visa

If you are in a married or de facto relationship with an Australian Citizen or permanent resident, and are going to be outside of Australia when you apply for your partner visa, you will be applying for a subclass 309/100 partner visa.

You will need to decide if you are applying under 'de facto' grounds, or if you are married to your Australian Citizen or permanent resident partner, thorough spousal grounds.

The subclass 309/100 can be made by a paper application or by creating an ImmiAccount and lodging it there.




If you are lodging a paper application, you will need to complete forms: 40SP, 47SP and have 2 form 888's completed by Australian citizens or permanent residents as witnesses to the genuine nature of the relationship. Both you and your partner will need to write statements outlining the background of your relationship, and you will also need to attach strong evidence of the genuine nature of the relationship.
